The next hearing of the case registered at the Kolkata High Court by the GNLF head, Subash Ghising, ABGL leader, Pratap Khati and Prabin Gurung and Gyabu Lepcha of People’s Forum against the GTA is scheduled for September 28, 2012.Khati, who is an advocate by profession, today speaking about the case, said that earlier the hearing was conducted on September 14 by Justice Dipankar Dutta. Further, commenting about GTA he alleged that it is un-constitutional. “If this is as per the constitution then why there are no reservations? On what basis laws are being made under GTA without dissolving the DGHC?” Khati questioned. Hence, we 4 people looking at such drawbacks of GTA has approached the Government of India, State Government, Morcha, District Administration, Sub divisional Administration etc and filed a case against it in the month of June or July.Further, Khati informed that the State Law Department, Chief Secretary, Samar Ghosh as per the GTA notice on March 12, had notified that there are 74 points under GTA, and the GTA is in replace of DGHC being the 74th and the final point. But on March 14 Ghosh had notified that except for the 74thpoint the rest 73 points is lawful. Therefore, it proves that till date DGHC has not been cancelled. “The Government by approving the un-constitutional GTA has tried to blindfold the public, he alleged.On the same context, Justice Dutta has also directed the State Government to give GTA a constitutional recognition.Khati has further claimed that by next hearing the GTA cancellation orders will be out.
