National Human Rights Commission recieved Shipsu firing case

We enquired about the status of the complaint lodged at National Human Rights Commission , New Delhi regarding the firing incident at Shipsu Forest Village on 08.02.2011 wherein as a result of indiscriminate firing by the police on peaceful Gorkhaland protesters of GJMM,  three youths had lost their lives and several others were severely injured. We had sought  intervention of the Hon'ble Commission for an independent inquiry and speedy justice.  The NHRC had asked for report from the concerned State administration and as per the report submitted by the Suprintendent of Police , Jalpaiguri an unruly mob of around 1000 people belonging to GJMM  were shouting slogans. The Executive Magistrate declared the assembly unlawfull and the police had no other option but to open fire to save lives and damage to property.

Two criminal  Complaints dated 08.02.2011 bearing Case No 18/2011 pertaining to the death of  Bimla Rai & Vicky Lama and other complaint dated 12/02/2011, bearing Case No 20/2011 relating to the death of Neeta Khawas have been filed at Nagarkatta Police Station.  . The Suprintendent of Police , Jalpaiguri   has submitted the Post Mortem report of  the three deceased persons . The Hon'ble Commission   had  further directed DM Jalpaiguri and  SP Jalpaiguri to submit Medical Examination Report (MER)  alongwith the status  of investigation and  information if any financial assistance were  given to the  Nearest Of Kin (NOK) of deceased persons and the injured persons.

All reports and documents pertaining to case have been recieved by the NHRC and now the matter has been put up before Division Bench ie a bench of two judges to pass the final judgment. GJMM unit of Delhi & NCR is keeping a close track on the matter and  Ranjan Sharma, General Secretary of Delhi unit of GJMM says that he is hopeful that justice will be given to the deceased persons. If in case any advese order is passed we shall challenge the observation of NHRC before the Hon'ble High Court and the Supreme Court under the due process of law. We are hopeful that the judgment will be passed soon.
